Privacy Notice
This notice explains how Emar Rent a Car processes your personal data when you make a reservation, rent a car or use our website, in accordance with the Turkish Personal Data Protection Law No. 6698 (“KVKK”).

2. Personal data we process

3. Purposes
- Receiving and confirming your reservation, concluding and performing the rental contract,
- Handing over and taking back the car and documenting its condition (mileage, fuel, photos),
- Calculating prices, deposits, extensions and extra mileage; invoicing and accounting,
- Complying with legal obligations, including identity notification, rental vehicle records and inspections by law enforcement,
- Handling traffic fines, tolls, accidents, damage and insurance, including notifying the driver's details to the relevant authorities,
- Establishing, exercising and protecting our legal rights in disputes,
- Protecting our vehicles and business, including internal-only notes about previous rentals in which problems occurred,
- Measuring customer satisfaction: sending you a personal review link after your rental and publishing reviews you submit for publication,
- Answering your requests and complaints.
We do not use your data for marketing and do not send you commercial electronic messages. We do not ask for credit scores or similar financial history reports.
4. Collection method and legal grounds
Your data is collected through our website reservation form, by phone, WhatsApp, e-mail and in person at our office or the delivery point, partly by automated means. It is processed on the following grounds under Article 5(2) KVKK:
- (a) expressly provided by law and (ç) compliance with a legal obligation: Identity Notification Law No. 1774 and its regulation, the Regulation on the Rental of Motor Land Vehicles, Highway Traffic Law No. 2918, tax and commercial legislation,
- (c) performance of a contract: reservation, rental contract, handover, return and billing,
- (d) made public by you: reviews and ratings you send for publication,
- (e) establishment, exercise or protection of a right: damage, fines, receivables and disputes,
- (f) legitimate interest: handover / return photos, vehicle security, internal customer notes, service quality and anonymous website statistics, provided your fundamental rights are not harmed.
Identity and driving licence details are required to conclude the rental contract and to meet our legal obligations; we cannot rent a car without them. Our service is never made conditional on giving any additional consent.
5. Transfers
Limited to the purposes above and only as necessary, your data may be shared with:
- Competent public authorities: police and gendarmerie (identity notification and rental vehicle records), the Ministry of Trade rental vehicle information system, authorities handling traffic fines and tolls, courts and enforcement offices,
- Insurance companies and loss adjusters in case of accident or damage,
- Our accountant, lawyers and auditors,
- Banks and payment institutions for pre-authorisations, payments and refunds,
- Technology providers we use: website, database and file hosting (Cloudflare), business e-mail (Google Workspace), reservation notification e-mail (Web3Forms), messaging (WhatsApp – only if you contact us through it).
Transfers abroad: As the servers of these technology providers may be located outside Türkiye, your data may be transferred abroad through them. Such transfers are carried out in accordance with Article 9 KVKK.
Our internal notes about customers are never shared with other rental companies or with any shared “blacklist” system.
6. Retention
- Rental contracts and related documents: at least 5 years from the transaction date, as required by the rental regulation,
- Invoices and accounting records: 10 years under tax and commercial law,
- Handover / return photos and document photos are archived and removed from our online system at least every 30 days, and kept in the archive for the contract retention period,
- Unanswered or cancelled reservation requests: for a reasonable period once no longer needed,
- Published reviews: until you ask us to remove them.
After these periods your data is deleted, destroyed or anonymised.
7. Cookies
Our website does not use advertising or tracking cookies. Visits are counted with an anonymous code that changes every day. Your language choice is stored only in your own browser. To load fonts, your browser connects to Google Fonts servers. The admin panel is used only by our authorised staff and uses a session cookie.
8. Your rights (Article 11 KVKK)
You may ask us to tell you whether your data is processed and request information about it; learn the purpose of processing and whether it is used accordingly; know the third parties in Türkiye or abroad to whom it is transferred; have incomplete or incorrect data corrected; have it erased or destroyed under Article 7; have corrections and erasures notified to third parties; object to a result against you arising solely from automated analysis; and claim compensation for damage caused by unlawful processing.
9. How to apply
Send your request with your name, surname, signature (for written requests), nationality and passport number (or Turkish ID number), address, contact details and the subject of your request:
- in writing to our address above, in person or via a notary,
- from the e-mail address you previously gave us to info@emarrentacar.com,
- or by secure electronic / mobile signature or registered e-mail (KEP).
We will answer free of charge within 30 days at the latest; a fee set by the Personal Data Protection Board may be charged only if the request requires an additional cost. You may lodge a complaint with the Personal Data Protection Board if your request is rejected, the answer is insufficient or not given in time.
